    Alabama Seizes 7 Children from Family After Child with Autism Wandered to Neighbors

    An Alabama couple is afraid that they may never get their children back. All 7 of their children were taken by DHR (the state’s child protective services) after their not-yet diagnosed child with autism began wandering off. It is called “elopement” in the autism community, and is very common in children diagnosed with autism, happening in 49% of these kids, even in the best of homes and the most carefully guarded of situations. It is scary, but experts say that it does not at all reflect poor parenting.

    It has now been over a year since Sabrina and Tony Cartee’s children were taken, and the state plans to file to terminate their parental rights for all of their kids, including the baby who was born in September, after the other children were taken by DHR. The breastfeeding newborn was seized at only a day and a half old and placed in a foster home.

      Attorney Emord: Arkansas Seizure of Stanley Kids is an Extraordinary Abuse of State Power

      Constitutional attorney Jonathan Emord hosted the Robert Scott Bell show and discussed the current situation in Arkansas where local law enforcement together with social services took custody of Hal and Michelle Stanley’s seven homeschooled children by force. Emord stated that based on what is known, the Arkansas seizure of the Stanley children looks like “an abuse of power that is extraordinary.”

      Emord said that the Stanley children are “essentially incarcerated,” because they have been taken by the State and kept away from their parents before there is any trial on the merits of any charges.

        7 Children Kidnapped by State of Arkansas from Homeschool Family to Remain in State Custody

        It will be at least “6 more weeks of kidnapping” for the 7 homeschooled, homebirthed Stanley children, according to their father. Hal and Michelle Stanley were given no warning that their court hearing scheduled for February 12 would be abruptly postponed until March 23. They say they were not given any explanation as to why the hearing was postponed.

        They had been under the impression that their children would be coming home after the hearing, and had held onto the hope that the crazy situation would be resolved, and their family would be reunited. The pain in their voices was palpable as they expressed their disappointment and grief over the postponement.

        The father explains to Health Impact News that they are only allowed to visit with their children a few hours a week, under strict supervision. There has to be two observers, and if they talk about things they are not supposed to discuss with their children, the visit is cut short. As a condition to these supervised visits, Hal and Michelle must attend “parenting classes,” even though they have homeschooled their children for many years.

          Family Defense Center in Illinois Documents Medical Ethics Violations in Medical Kidnappings

          The Family Defense Center’s mission is to advocate justice for families in the child welfare system. The Family Defense Center works on cases of wrongly-accused families who are targeted as a result of Hotline calls to child protective services.

          The Center is able to represent only a tiny fraction of the wrongly accused family members in medically complex cases, and resources like the Center provides are not available to the vast majority of family members who encounter the child protection and medical care establishment in these cases.

          Unfortunately, we see little sign that the child protection and medical care establishment are addressing in a meaningful way the harmful impact of erroneous child abuse reports that have resulted from questionable ethical practices that this Paper documents.

          Physicians have an ethical responsibility to mitigate damage to families. Yet, in no case handled by the Center has this responsibility been met by the medical community; after exoneration, no family has received any offer of assistance or healing by any of the physicians who have caused them injury.

              2 Children Awarded $1.1M From Medical Kidnap Case

              Two children removed from their home in San Diego by county social workers will receive more than a million dollars as part of a settlement deal. The two children were apparently injured at a daycare center, and when a doctor reported the daycare center, social workers showed up at the home instead and abducted the children, performing their own physical exam of the children without parental approval.

              A judge ruled taking the children away was unconstitutional since a call to the day care would have confirmed the injuries happened there. The county’s physical exam of the two children was also deemed unconstitutional and the consent forms inadequate.

                Could the day come in the United States of America where parents who refuse to vaccinate their children will have their children removed from their home by force and injected with vaccines they do not approve of against their desire?

                  The police literally ripped 14 month old Levi from his mother’s breast, reports Erica May Carey, as she was nursing him in the car at a California gas station. Her baby was screaming, and she says her breast was exposed as the officers dragged her from the car. As she recounted the events of last Thursday, Erica began weeping, saying that she was “hogtied like an animal, when moments before I was nursing my infant.” She was arrested and jailed for fighting to keep her children with her, she tells Health Impact News.                         Federal Lawsuit: Massachusetts Wrongly Took Child 2 Days After Birth Because Mother was Disabled

                        Two days after giving birth to her daughter, the state took away 19 year old Sara Gordon’s baby because Sara has a developmental disability, and placed her baby in foster care. The federal government says the state violated her civil rights by discriminating against her because of her disability.

                        The National Council on Disability, an independent federal agency advising the White House and Congress, says the case points up a growing problem: states needlessly taking custody of the children of disabled parents.

                        “Parents with disabilities are suffering significant discrimination,” said Robyn Powell, an attorney for the council. “What happened to this mother is very common … States are removing these children for the sole reason of their parents having a disability.”

                          Lawsuit in San Antonio Claims CPS is Kidnapping Latin American Babies

                          The League of United Latin American Citizens filed a federal lawsuit on Feb. 6 against Child Protective Services, alleging the department abused its power.

                          LULAC said that CPS took a 10-day-old baby away from its mother because of alleged drug use. The woman and baby did not test positive for drugs, but CPS still took the baby away.

                          Julie Marquez, with the LULAC Council in Seguin, said the case is nothing out of the ordinary for CPS.

                          “We have several cases … We have more than 10 cases. It’s the same M.O. over and over and over again. They withhold evidence and they abuse their discretion and they abuse their power,” Marquez said.

                            A little boy recovering from a brain tumor has been has been taken from his mother, in what some are calling a medical kidnapping in Connecticut.                               Parents Get $800K Over Warrantless Search and Removal of Homeschool Kids Who Were Not Vaccinated

                              KPCC reported this week that the Los Angeles County Board of Supervisors will pay $800,000 to the parents of two children taken from their home by a Sheriff’s deputy and social workers with the Department of Children and Family Services, who did not obtain a warrant first.

                              According to KPCC, the lawsuit states that the complaint used by DCFS centered around what the homeschooled family chose to feed their children, and for failing to vaccinate them: Social workers with the Department of Children and Family Services claimed the parents “created a detrimental and endangering home environment” for the children by failing to provide nourishing food and immunizations.

                              The lawsuit describes the deputy mocking the parents for not immunizing their children based on religious beliefs and homeschooling them. It accuses him of coercing the parents into a search of their hotel room.

                              “You could lose your kids forever,” he allegedly threatened.

                                Rengo Family Children Taken Back into State Custody in Washington, As Family Tries to Flee CPS

                                The Rengos reportedly left their home in Washington to avoid having CPS take their children away again, but on February 5, 2015, they were picked up in California, and the children were taken away from them by force.

                                According to ksbw.com:

                                “Cleve Goheen-Rengo, 23, and Erica Carey, 29, fled from their Washington home with the three children. A warrant was not issued for their arrest, but a Be On The Lookout was issued by Bellingham police to West Coast law enforcement. Bellingham police officers said it was not a criminal kidnapping or Amber Alert investigation, but rather a civil violation by defying CPS court orders.”

                                So while no criminal charges were made against the parents, nevertheless, the children will be returned to State custody in Washington.

                                The children seemed OK, according to California authorities.

                                “They didn’t appear to have any obvious injuries or ailments,” (California Highway Patrol officer) Sadek said.

                                Carey (the mother) was arrested for refusing to cooperate with Santa Cruz County law enforcement. She reportedly shouted out:

                                “Send a message to America for me. Children don’t belong to the government. The government belongs to the people.”

                                      BREAKING: ARIZONA SUED BY ABUSED FOSTER CHILDREN!

                                      The Associated Press and many other media outlets today (February 3, 2015) have announced that a federal class-action lawsuit was filed against the directors of the Arizona Department of Children’s Services and the Department of Health Services by ten foster children in Arizona.

                                      The children in the lawsuit are represented by the groups Children’s Rights, the Arizona Center for Law in the Public Interest, and Phoenix law firm Coppersmith Brockelman PLC.

                                      Arizona’s treatment of foster children is so bad it actually puts kids at risk of greater harm, says the federal class-action lawsuit. The lawsuit, which names as plaintiffs 10 foster children ages 3 to 14, said the agencies failed to address ongoing failures. The suit also accuses the state of a “widespread failure to engage in basic child welfare practices aimed at maintaining family relationships.” That includes placing siblings together, trial reunifications with parents, adequate visitation between children and biological families, and having caseworkers visit parents to work toward reunification.

                                        Shocking Revelations of Corruption in Leanna Smith Medical Kidnapping Case in Arizona

                                        Arizona Family advocate Steve Isham was interviewed on the Robert Scott Bell radio program on Sunday February 1, 2015 to discuss the Leanna Smith medical kidnapping story.

                                        Leanna Smith claims that the State of Arizona, working together with doctors who were covering up medical malpractice with her oldest daughter, worked together with CPS to have both her daughters removed from her custody, and that they have been psychologically and sexually abused in foster care.

                                                Was Teenager Marc Herrmann Medically Kidnapped As Part of a Cover-Up for Malpractice in Canada?

                                                None of the story makes sense to the Herrmann family. After a series of medical misdiagnoses and incorrect treatments, their teenage son Marc was taken into custody by Canada’s Child and Family Services (CFSA) and eventually placed in foster care. Now the system wants to keep him forever, even though he turns 18 next month.

                                                There are many questions that remain unanswered, according to Marc’s parents Patricia and Gottfried Herrmann. He was somehow diagnosed as retarded and is being held as a PDD – Person with Developmental Disabilities. Even though he will turn 18 next month, if the Canadian government has its way, Marc will not be able to go home, which is the place he wants to be more than anything else. Instead, he will become a ward of the Office of Public Guardians, an organization that was designed to care for Canada’s neediest citizens. His family wants to know why he will be taking up valuable resources that others truly need, when he obviously does not need them.

                                                  Does the State Ever Have a "Right" to Remove Children from a Home?

                                                  When does the State have the right to remove children from a home where they are living with their parents?

                                                  We have been covering medical kidnapping stories now on MedicalKidnap.com for over a year. This website was started to document the many stories that were coming to our attention where families were losing their children to the State, and the foster care system, over medical disagreements. In many of these cases, their children were taken away simply because they disagreed with a doctor, or wanted to take their children to a different doctor to get a second opinion.

                                                  Does the State have a right to take children away from parents for what is now being called “medical abuse,” a term used by medical authorities when parents disagree with doctors, or want to seek a second opinion? Most of the people who follow MedicalKidnap would state “no.” And we have published many stories now showing that this is indeed happening all across the country, in every state, every single day.

                                                  But what about in other situations? Are there any situations where authorities should step in and remove children from their homes, taking them away from their parents?

                                                  Judging from comments made in social media from many commenting on some of our articles, I think it is safe to assume that the majority of people in the United States today feel that in certain situations, the State has a legitimate right to step in and take children away from their families, removing them from their homes.

                                                  However, I would like to suggest that the Constitution of the United States of America protects the rights of individuals and families, and that it is never lawful for social services to remove a child from their biological parents, taking them out of their home and making them a ward of the State, removing legal custody from their parents. This phenomena is a recent development in the history of our country, and if it is not lawful to take such actions, we are correct in calling such actions “state-funded kidnappings.”

                                                                  Arkansas Takes Away 7 Homeschool Children because Father had Unapproved Mineral Supplement

                                                                  Relatives of the Stanley family in Garland County, Arkansas have reached out to MedicalKidnap.com to notify the public that the 7 homeschool children of Hal and Michelle Stanley were removed during the night by DHS and fully armed sheriffs this past week, simply because they reportedly found a supplement in the home that was not approved by the FDA.

                                                                  The mother sent an emotional email to family and friends describing what happened. Some quotes:

                                                                  “All the little kids were upset and Hal and I and the girls were all crying and in shock. When I did calm down for the kids’ sake, and try to comfort them they ripped them away from us saying that we had already taken too much time and that they had to go. I still can’t believe they are gone. I have no idea what will happen tomorrow or what comes next.”

                                                                    Friday January 16, 2015 the Shoars family had a hearing in Arizona family court over the custody of their 7 children that were taken away by the State after the accidental death of their three-year-old daughter Khloe.

                                                                    At this hearing, the judge reportedly issued a gag order on the parents, and ordered them to stop discussing the case on the Internet.

                                                                    Two days before this hearing, on Wednesday January 14, 2015, Tabitha Shoars was interviewed by Ty Bollinger on the Robert Scott Bell syndicated national radio program. On the Friday night (January 16, 2015) broadcast of the Robert Scott Bell show, they reported that a “Detective Kalcum” from Arizona had contacted their syndicator wanting to “subpoena” the broadcast of the show with Tabitha Shoars.

                                                                      CPS Threatens to Take Children Away from Parents for Letting Them Walk to the Park

                                                                      Danielle and Alexander Meitiv say they are being investigated for neglect…. in a case they say reflects a clash of ideas about how safe the world is and whether parents are free to make their own choices about raising their children.

                                                                      On Dec. 20, Alexander agreed to let the children, Rafi and Dvora (ages 10 and 6), walk from Woodside Park to their home, a mile south, in an area the family says the children know well.

                                                                      The children made it about halfway. Police picked up the children near the Discovery building, the family said, after someone reported seeing them.

                                                                      Danielle said she and her husband give parenting a lot of thought.

                                                                      “Parenthood is an exercise in risk management,” she said. “Every day, we decide: Are we going to let our kids play football? Are we going to let them do a sleep­over? Are we going to let them climb a tree? We’re not saying parents should abandon all caution. We’re saying parents should pay attention to risks that are dangerous and likely to happen.”

                                                                      She added: “Abductions are extremely rare. Car accidents are not. The number one cause of death for children of their age is a car accident.”

                                                                      Danielle is a climate-science consultant, and Alexander is a physicist at the National Institutes of Health.

                                                                      The Meitivs say that on Dec. 20, a CPS worker required Alexander to sign a safety plan pledging he would not leave his children unsupervised until the following Monday, when CPS would follow up. At first he refused, saying he needed to talk to a lawyer, his wife said, but changed his mind when he was told his children would be removed if he did not comply.

                                                                        Author and Attorney: Medical Kidnapping of Children is Very Real

                                                                        A nationally known author and attorney tells KMOX News she’s worked with parents who know that medical kidnapping is very real.

                                                                        Beth Maloney has written Childhood Interrupted and Saving Sammy – both about her battle to get a proper diagnosis for her son, who suffered neuropsychiatric disorders as a result of a simple strep infection.

                                                                        She now advocates for other families.

                                                                        “These are parents who are taking their children to the emergency room of hospitals because their children are desperately ill and they are trying to find help,” she says.

                                                                        Instead, Maloney says she’s seen parents who end up on the receiving end of allegations – “medical neglect and doctor shopping, and the next thing you know, the hospital has notified the state and state jumps in and takes custody of the children.”

                                                                          New Missouri Bill Filed to Prevent Medical Kidnapping

                                                                          Rep. Wilson from Smithville said, “Parents have a right to make sure their child is receiving the medical care that they deem necessary, and a second opinion? Why is that an issue?”

                                                                          The bill would protect a guardian from charges of abuse or neglect if they seek another opinion by a licensed health provider and the parent follows that prescribed treatment.

                                                                          “I wouldn’t think you would have to pass legislation to make sure a parent’s rights are supreme, but apparently we do,” said Wilson.

                                                                            Arizona CPS Takes 7 Children Away from Parents after Accident

                                                                            The unthinkable happened to a family in Arizona. Their three-year-old daughter mysteriously collapsed while her parents were away from home, and she died shortly after. As horrible as that tragedy was, Khloe’s death was only the beginning of the devastation to the Shoars family. Child Protective Services immediately came in and took away all seven of their other children, placing them in various foster home settings around the area.

                                                                            The children now don’t have their parents, or even each other, as they try to grasp what has happened to their sister. None of the children, ranging in age from 2 to 9 years old, have been placed with family or friends, and they cry to come home. They don’t understand what has happened, and neither do their parents, Jeff and Tabitha Shoars.

                                                                            “It’s like a bad nightmare you can’t wake up from,” says Jeff.

                                                                            No charges have been filed against anyone, yet the state of Arizona has already begun the TPR process, Termination of Parental Rights.

                                                                                Foster families in Washington State are under a new mandate that everyone in their house needs a flu shot if they have foster kids under two years of age. If they don’t comply, the children will be taken from them. This is in spite of the fact that the flu vaccine is both dangerous and largely ineffective.

Recently, he has come forward publicly with devastating information about the trauma that he experienced as a ward of the state of Illinois. While he was in a Chicago foster home, he was raped and sodomized.                                                                                     Connecticut Supreme Court Sides with DCF, Girl to Remain in Custody for Forced Chemotherapy

                                                                                    A Windsor Locks teen faced a judge in Connecticut State Supreme court Thursday after she’s been forced to undergo chemotherapy against her will. She is identified as Cassandra C. in court papers, and she believes she should be allowed to make her own health care decisions even though she’s a minor.

                                                                                    After roughly one hour of arguments, the court sided with Department of Children and Families and determined she must remain in state custody to continue forced chemotherapy.

                                                                                                Woman Arrested for Filing 28 False Child Abuse Reports in Florida

                                                                                                A Florida woman was recently arrested for making too many false charges of child abuse to the Florida Department of Children and Families, which were reportedly directed against two families. When asked why she made the multiple false child abuse charges, her reply reportedly was “to create havoc.”

                                                                                                According to Chipleypaper.com, Jessica Elizabeth Combee, 28, of Westville, Florida is charged with 28 felony counts of false child abuse reports, and is currently being held in the Holmes County Jail with a $28,000.00 bond.

                                                                                                As the testimony from the Bonifay Police Chief reveals, this is a common practice of how people abuse the child welfare system for their own agenda. We hope that more people will be prosecuted for abusing the system, including not just nosy neighbors or jealous family members, but medical personnel as well who take out their anger against parents who choose not to follow their medical advice, or want to seek a second medical opinion. Those doctors also deserve to be arrested and prosecuted for false charges.

                                                                                                  Cassaundra Brown is heartbroken because she is missing her twins’ first Christmas. Instead of watching 9 month old Arianna and Dominick delight in the Christmas lights and new toys and pretty bows, she and Warnell Ludington are caught in desperate fight for their babies with DCFS, the child protective services department in Illinois, over what they believe in their hearts is a misdiagnosis.

                                                                                                  Cassaundra says, “I can’t even believe this is happening.”

                                                                                                  The crux of the twins’ removal from their parents allegedly lies in an accusation of Shaken Baby Syndrome, a diagnosis which is surrounded by growing skepticism by medical experts, and which does not take into account Arianna’s history of medical complications since her birth. Though the parents have reportedly not been charged with any crime, their children have been seized by the state; and they are only permitted to see them for two hours per week.

                                                                                                  Their visit this week was canceled because the foster parents are out of town for the Christmas holidays.

                                                                                                  This foster home is the twins’ fourth foster home in five months.

                                                                                                  Their parents are grieving because they are “missing out on every first,” and just want their babies back.

                                                                                                    Medical Kidnap Case in South Dakota Featured in Local Media

                                                                                                    Reporter Bridget Bennett and KSFY in Sioux Falls, South Dakota reported on the Medical Kidnap case of Molly and Michael first reported at Health Impact News’ website MedicalKidnap.com. Molly and Michael will be spending Christmas without their three children, simply because they brought their 2-month old son to the emergency room after they discovered an injury to his tongue after picking him up from daycare. The doctor reported them to CPS, and they lost custody of all three of their children, even though there was no evidence of abuse. The police reportedly removed the children from the home without a warrant, allegedly stating that they “didn’t need one.”

                                                                                                      The City of San Diego will pay $225,000 to settle a civil suit filed by a teen mom who lost parental rights to her daughter just days after the child’s birth. Johnneisha Kemper says San Diego Police officers took her baby away in 2008, just days after she gave birth at the age of 16, claiming she was unfit to raise the newborn. Now, the city of San Diego has approved a settlement in the civil rights lawsuit filed alleging the SDPD took the child without threat or warrant. “The system did fail her in every way that she could have been failed,” her attorney Shawn McMillan told NBC 7. McMillan said they pushed for a policy change and training for officers in how they remove children but the City refused and even offered more money instead agreeing to change.

                                                                                                      McMillan has been fighting for the parents, he says, are being ripped away from their children. “We see this over and over and over again. We know it’s a systemic problem, and we’ve been looking for a way to address this systemic problem so we can get real permanent change,” he said.

                                                                                                      That change he’s hoping will come from a federal class action lawsuit filed this week in Riverside County. The plaintiff is a newborn. The lawsuit says the baby was taken from its mother without a warrant by the Riverside County Department of Social Services while the two were still in the hospital.

                                                                                                      “You absolutely cannot seize a child from its parents unless there is reasonable evidence to show that the child is likely to suffer severe bodily injury or death in a two hours it takes to get a warrant,” said McMillan.

                                                                                                      “You saw what the police in San Diego said, they said we’re not changing anything. We’ll pay the money and we’re going to keep on doing what we’re doing, but that doesn’t work for us. What we’re really looking for here is a government that’s going to follow the law and protect its citizens,” he said.

                                                                                                              Courthouse News Service is reporting that Attorney McMillan is representing a federal class action lawsuit against “Riverside County, Juvenile Dependency Investigator Karla Torres, Torres’s supervisor Felicia M. Butler, and all similarly situated county social workers and investigators” for taking “a newborn baby from her mother without a reason or a warrant,” and for making “a habit of it.” The suit claims that the Southern California County takes “thousands of babies” without cause.

                                                                                                                    We have reported on many families’ stories of medical kidnappings here on MedicalKidnap.com. For every story we tell, there are probably 10 more we cannot get to. In almost all of these cases there is massive abuse of power exerted by medical doctors, CPS social workers, and family court judges.

                                                                                                                    But this story from Homeschool Legal Defense Association (HSLDA) shows a new level of alleged corruption: CPS caseworkers and a family court judge actually withholding evidence from medical personnel that would have shown their seizure of a child was not justified. Instead, they allegedly relied on a non-medical professional, a CPS caseworker, to take children away from their family based on their own unprofessional medical opinions, ignoring doctor’s advice to the contrary, and even allegedly suppressing that evidence in court.

                                                                                                                      Another Arizona Medical Kidnapping: 4 Children Removed from Family after Booster Seat Accident

                                                                                                                      “Surprise (Ariz.) police came in, (DCS) came in and told my wife she was going to prison,” the boy’s father told KTAR News on Monday. “They just started threatening her — basically trying to force a confession of something that didn’t happen.”

                                                                                                                      The family’s attorney, Alane Roby, believes the case was grossly mishandled. According to Roby, the Department of Child Safety has not much different than the original state agency entrusted to protect Arizona’s children.

                                                                                                                      “Case workers are overworked, underpaid, there’s no accountability. The case workers are generally very young, inexperienced and don’t understand the ramifications of the decisions they make. Children are ripped from their homes, placed in foster care even when family members are available to care for them and often,” Roby said. “The scariest thing in the world is that this could be happening to anyone and they’d be going through the same thing,” Roby said.

                                                                                                                        Crystal Bentley, 23, entered the Texas foster care system when she was 2 and wouldn’t leave it until she aged out at 18.

                                                                                                                        In the intervening years, as she was shuffled from place to place, she was repeatedly beaten and sexually abused — sometimes by the adults entrusted with her care, sometimes by their biological children, sometimes by other foster kids or her own relatives, Bentley testified in federal court Wednesday.

                                                                                                                        A rotating cast of Child Protective Services caseworkers who were supposed to watch out for her safety often didn’t show up for monthly visits, she said. When they did visit, it was usually for a cursory handful of minutes during which they failed to detect what was happening to her.

                                                                                                                        “I would hint that something was going on, but when they asked me if I was being sexually abused, it was always right there in front of my abusers,” Bentley testified. “What could I say?”

                                                                                                                        Bentley’s testimony Wednesday came on the third day of a trial in a class-action lawsuit brought by Children’s Rights, a New York-based advocacy group on behalf of 12,000 children in long-term state care in Texas.

                                                                                                                          The Fourth Amendment strikes a carefully crafted balance between a family’s right to privacy and the government’s need to enforce the law. In most situations, government agents cannot simply force their way into a home. Instead, they must explain to a neutral magistrate why they need to enter the home, and they must provide real evidence to support that need. This rule applies to all government agents. Court after court has agreed that there is no social services exception to the Fourth Amendment.

                                                                                                                          All too often, law enforcement officers and child-welfare workers act as if the Fourth Amendment does not apply to CPS investigations.

                                                                                                                          They are wrong.
