    Attorney Reporting in Newsweek: Foster Care is a System Set Up to Sex Traffic American Children

    Attorney Michael Dolce, from the law-firm Cohen Milstein, recently wrote an opinion piece published by Newsweek stating that the nation’s foster care system is set up to sexually traffic children.

    Dolce, who speaks from experience from representing children abused in foster care, writes:

    “Here’s the ugly truth: most Americans who are victims of sex trafficking come from our nation’s own foster care system. It’s a deeply broken system that leaves thousands vulnerable to pimps as children and grooms them for the illegal sex trade as young adults.

    We have failed our children by not fixing the systemic failures that have allowed this to happen for decades.”

      Alabama Newborn Baby Kidnapped at Hospital with No Warrant, No Court Order, No Emergency Circumstances

      It should have been one of the happiest times in the young couple’s life. It started out that way.

      Two weeks ago, on Monday, February 26, 2018, Chelsea Thomas, 18, gave birth to a beautiful, healthy baby boy in Birmingham, Alabama. Their first-born son was everything that she and her 19 year old fiance’ Brian Stokes had hoped for.

      They immediately fell in love with their “sweet prince” who has daddy’s nose and mommy’s lips. Baby Kason was their whole world.

      Then, their world was shattered.

      At 3 pm the very next day, Chelsea had just breastfed her baby and he was asleep in her arms. A nurse came into the room and said she needed to take Baby Kason to the nursery “for an assessment.”

      He never came back.

      Less than an hour after the nurse took their baby out of the room, Chelsea received a phone call from a lady with the Steps Ahead prenatal program telling her that she was required to notify the Department of Human Resources (DHR – Alabama’s Child Protective Services) when the baby was born.

      She told them that DHR had taken custody of Baby Kason. He was in lockdown in the hospital nursery and the parents were not permitted to go near the nursery.

      There was no reason given. There was no warrant. No court order. No emergency circumstance. Nothing. Their baby had only been with them for little more than 24 hours.

      It turns out that, even though Chelsea is 18, Jefferson County DHR still legally has custody over her, because she is a former foster child. As such, it appears that they get to call the shots – up to and including taking her baby away from her.

        Disabled Virginia Mom Arrested with No Warrant, No Charges Because Health Impact News Exposed her Story

        Police have arrested a mother in Virginia. She was charged with no crime. There was no warrant. Tara Chapman, who has a mental health disability, was reportedly dragged out of the house, placed in handcuffs, and taken away in a police car yesterday, March 7, 2018.

        She was taken to a mental health facility where she was handcuffed to a hospital bed.

        Whitney Manning is her mother, and she has been fighting Tennessee’s Child Protective Services for her daughter and grandchildren for several years. She is terrified for the very life of her daughter.

        Attorney Connie Reguli told Health Impact News that she believes that Tara’s arrest was “all retaliation” for their story being exposed. She said that Tara was not a threat to herself or to anyone else.

        “She was TRULY medically kidnapped. They are treating her like a criminal. This is true abuse of the mentally ill.”

        Tara Chapman had graduated with honors from college and had a teaching degree. The Tennessee Department of Children’s Services (DCS) became involved during a time when Tara was being abused by her sons’ father. She had struggled with depression and bipolar disorder to some degree before that, but her children being taken literally drove her crazy.

        Now, after exposing her story to the public, a court has removed her mother as her guardian and placed under the custody of the State, and her family does not even know where she is located.

          Disabled Parents Losing Right to Parent their Own Children in America while Foster Parent Recruitment Seeks "Imperfect Parents"

          Parents with disabilities face challenges in raising their children. One challenge that many may not have expected, however, is the right simply to BE a parent.

          A recent article by the Pacific Standard describes the “uphill battle” that parents with disabilities face to keep their own children. The statistics cited are alarming:

          “Research indicates that parents with disabilities and their families are overrepresented in the child welfare system.

          While parents with disabilities make up only 6.2 percent of all parents in the United States, a recent study found that 19 percent of children in foster care have a parent with a disability.”

          According to data from the Child Maltreatment report for 2016 from the U.S. Department of Health and Human Services, only about 25% of the children coming into the system are taken for reasons of physical or sexual abuse.

          Most children placed into the foster care system were not abused. Nationally, only 17.2% of the allegations against parents are even substantiated.

          Yet, disabled parents are losing their children at a higher rate than the general public. Sometimes, their disability is the sole reason for their children being taken from them. What is worse is that they are less likely to get their children back once the state takes them. All of this violates the Americans with Disabilities Act (ADA).

          The Ad Council slogan, “You don’t have to be perfect to be a perfect parent” is aimed at potential foster and adoptive parents, but it is a slap in the face to real parents who are told by the state that they cannot parent their children because they are less than perfect.

            Healthy Boston Woman is Medically Kidnapped and Forced onto Pysch Drugs Resulting in her Death

            Another Boston area woman’s life has been cut short after elder “protective” services and guardians became involved. The story of Alice Julian’s medical kidnapping is shocking and horrifying in that it shows the almost omnipotent power of the state to override the decisions made by a citizen in preparation for their latter years.

            Alice Julian had a strong will to live. She was described as an “exceptionally healthy” 89 year old woman before being seized and drugged against her will. Her daughter Pamela Julian fought valiantly to save her life, but the strength of a group of Guardians, lawyers, and Jewish Family and Children’s Services proved to be too great a hurdle to overcome.

            She died on the morning of January 9, 2018.

              Pediatric Doctor Pleads Guilty to Illegally Targeting Teens for Cholesterol Drug Trials

              A Pediatric Cardiologist from Georgia has pleaded guilty to illegally targeting teens for a cholesterol drug that was only approved by the FDA for a rare disorder.

              According to court documents, Dr. Eduardo Montaña colluded with pharmaceutical company Aegerion to sell their drug Juxtapid to teenagers with heart problems, even though the drug was not approved for their conditions.

              Dr. Montaña violated HIPAA laws of patient privacy by supplying the pharmaceutical company private medical records of 280 teenagers without patient knowledge or consent.

              Drug company Aegerion was found guilty of criminal wrongdoing in a Massachusetts court.

              Juxtapid, which received FDA approval in 2012, costs over $330,000 per patient per year, so the drug company had strong financial motives to expand its sales.

              Dr. Montaña was a willing accomplice in their criminal activities, and reportedly hoped to get a kickback for himself. He requested a $236,000 grant from Aegerion.

              In the conviction against Aegerion in this case with Dr. Eduardo Montaña, District Judge William G. Young lamented how the U.S. Government allows criminal pharmaceutical companies to get off so easily, and continue doing business.

              Existing laws that protect pharmaceutical companies apparently prevented Judge Young from automatically issuing the harshest penalty, as the federal government generally strikes a plea bargain deal with the pharmaceutical company to keep them in business.

              Judge Young wrote: “What is left unexplained is why the government does not simply let Aegerion collapse in disgrace. Surely Aegerion is not too big to fail.”

                2 Years After Isaiah Rider Medically Kidnapped: “They Destroyed Our Whole World”

                It has been almost 2 years since Isaiah Rider was released from Illinois DCFS custody after being medically kidnapped. Like many families who are reunited after the trauma of dealing with Child Protective Services, Isaiah and his mother, warrior-advocate Michelle Rider, largely withdrew from social media and the public eye. The horrors they had experienced took a toll and they have needed time to heal.

                They recently shared their story with a reporter from KWIR, a publication whose audience is largely LGBT.

                Michelle Rider says that she wants their story to be told as a warning for parents. Reporter Gretchen Rachel Hammond writes:

                “Although not LGBT themselves, Michelle and Isaiah fear for both gay and straight couples who take a child to a hospital like Lurie for help and suddenly find themselves catapulted into a hell they could never have imagined.”

                In the opening of the series, Hammond makes this statement:

                “As an increasing number of LGBT couples choose to adopt, the story of one of the most disturbing and bizarre cases of DCFS removing a child after hospital doctors claim Medical Child Abuse serves as a warning.”

                The public may not be aware that the LGBT community contributes to the demand for children to adopt. The Rider article series by KWIR serves as a cautionary tale that the children offered up for adoption to LGBT couples, and to anyone else seeking to adopt, are not always “poor abused children in need of a forever home.”

                Adoptive and foster parents are not always told the truth about the children who are placed with them. Far more often than not, the children were taken from families who love them, who never abused them, and who have been falsely accused of hurting their children. Social worker whistleblowers have told us that they are encouraged to seize children who are “adoptable.”

                Adults wishing to adopt children increase the demand, whether they are LGBT couples unable to conceive on their own, infertile couples, couples with good intentions who want to help children, Christian and religious families seeking to care for “the needy and the orphan,” or even pedophiles.

                No matter the motive, whether good or bad, each serves to create the demand for children.

                As that demand increases, more children are being taken from innocent families in order to supply the commodities (children) to meet the demand.

                It is simple economics.

                    Public Warning: Boston is a Cesspool of Adult Medical Kidnappings

                    Boston is home to one of the first notorious cases of medical kidnapping that garnered widespread public attention, that of Justina Pelletier, seized by Boston Children’s Hospital and Child Protective Services, and confined against her will and the will of her family in a psych ward.

                    It appears that the Boston area is a hub for medical kidnappings of adults as well as children.

                    In at least 4 cases that we know of in the Boston, Massachusetts, area, there is a web of common players who are interconnected.

                    Jewish Family and Children’s Services is the common denominator for each of these senior citizens who were seized by Adult Protective Services.

                    Instead of foster parents, “guardians” are court-appointed to take control of their lives, assets, and medical decisions, leaving elder adults victims of strangers they have never met, isolated from their family and friends who are the ones that truly care about them. They are accused of having “mental illness” and confined to psych wards against their will.

                    Lonnie Brennan is the editor of a newspaper that has reported their stories, The Boston Broadside. He was recently threatened with arrest for trying to visit one medically kidnapped lady, Mary Frank, who was trying to reach out to him to get her story published. She was confined to a nursing home and psych ward against her will, and denied basic human rights. Her perpetrators did not want her story going public.

                    Lonnie told a local radio talk show host:

                    “Once they have you, you are better off going to the nearest liquor store and saying, ‘Hey, I’m robbing you.’ Because you’ll get better health care and you’ll get better freedom if you are in prison. I hate to say it.

                    And you’ll have more dignity in prison than you will have – than we have witnessed – in nursing homes.”

                      Florida Dad Wrongfully Convicted for Shaking Baby and Served 20+ Years of a 70 Year Sentence Featured on CNN

                      On February 17, 2018, CNN aired a Special Report titled “Broken Bones, Shattered Lives” which featured the story of James Duncan, who was convicted of child abuse for shaking his son who was an infant at the time. He has served over 20 years of a 70 year conviction for a crime he claims never happened.

                      A Florida appeals court has agreed to re-try the case.

                      CNN’s Jean Casarez interviewed James’ ex-wife and two sons (now adults) for the report, and they all maintain that James is innocent.

                      Jean Casarez also interviewed Dr. David Ayoub, a radiologist and expert on infantile rickets who stated: “It’s a bad diagnosis.”

                      He said he believes Kody had infantile rickets, a disease of early life in which bones do not mineralize properly. Ayoub said it led Kody to develop metabolic bone disease, causing his bones to be very fragile.

                      When Jean Casarez asked Dr. Ayoub how many parents he thought might be incarcerated today wrongfully on charges of Child Abuse for shaking their child, he replied “In the tens of thousands.”

                                Don’t Believe the Hype: The Family First Act is a Step Backwards for Child Welfare Finance Reform

                                Perhaps you’ve heard. Tacked onto the bill that averted another government shutdown is a child welfare finance “reform” measure called the Family First Prevention Services Act.

                                The bill was thought to be dead. It was killed last year by what one reformer who transformed his own institution years ago called the group home industry – the collection of private agencies typically paid for every day they hold foster children in the worst form of care, group homes and institutions — and their public sector allies.

                                But it came back to life as part of the process of keeping the government open. Now it’s law.

                                One might expect advocates of family preservation to celebrate, and some almost certainly will. The bill allows some federal money once restricted to funding foster care to be used for better alternatives. And, in theory, it curbs federal funding for group homes and institutions.

                                Some very good child welfare reformers favor the bill.

                                But I disagree. In 2016, I wrote that the range of prevention services that could be funded under Family First was tiny, and there were absurd restrictions on which programs within that range could get federal aid. And instead of limiting group homes and institutions, I argued that the bill was so weak that it actually strengthened them, creating a whole category of institution that would be, in effect, sanctified in federal law.

                                  Social workers and doctors decide her fate while strangers surround her. Her parents, once her entire world, are forcibly kept away from her except for occasional short visits.

                                  Her mother Leah Beabout says of her daughter:

                                  She’s just getting worse and worse. It’s like a horror movie.

                                  This may sound much like a futuristic sci-fi horror flick, but it is the present reality for Grace and her family, as well as for thousands of others across the United States of America.

                                  Grace has been medically kidnapped, and she is caught in an epic battle between Child Protective Services and the parents who truly want to protect her.

                                      Arizona Foster Care System Revealed as Pedophile Ring: Former Foster Child Tortured for Years Sues for $15 Million

                                      The state of Arizona, which has the infamous reputation of removing the highest percentage of children in the U.S. from their homes and families through Child Protective Services, has now also been exposed as having a very corrupt foster care network that includes pedophile rings where young children are imprisoned in state-approved foster homes and trafficked to pedophiles.

                                      In a developing story based out of the military town of Sierra Vista, Arizona, the home of Fort Huachuca, David Frodsham, a former commander with the Department of Defense in Afghanistan who was discharged from duty due to “sexual harassment” behavior and an assessment by the military that he had an unalterable personality disorder, has been arrested and convicted of operating a pornographic pedophile ring based out of his state-approved foster home.

                                      Health Impact News first reported on the charges brought against David Frodsham and his wife who were state-approved foster parents last year with the story of the young child Devani, who was seized from her family just days before her second birthday and placed into the Frodshams’ state-approved foster home where she was allegedly raped repeatedly and trafficked as part of an organized pornographic pedophile ring. After David Frodsham was arrested due to a federal investigation, Devani was placed into another state-approved foster home where 80% of her body was burned by scalding water, forcing the amputation of some of her toes.

                                      Now, another foster child who was adopted by the Frodshams and put into their pornographic pedophile ring has turned 18 and come forward to reveal details of years of horrible torture and sexual trafficking while suing the state of Arizona for damages of $15 million.

                                      How can this be happening today in the United States? How can we be talking about “making America great again” when this kind of child sex trafficking is happening right here in our own borders?

                                        Texas Judge: CPS Still Unconstitutional - Foster Care Sexual and Physical Abuse Still the Norm

                                        Two years ago (January 2016) Health Impact News reported that U.S. District Judge Janis Graham Jack had ruled against the State of Texas stating that the foster care system, named in a class action lawsuit on behalf of Texas foster children, was unconstitutional.

                                        In her 255 page ruling, Judge Jack wrote:

                                        “Texas’ PMC (Permanent Managing Conservatorship) children have been shuttled throughout a system where rape, abuse, psychotropic medication, and instability are the norm.”

                                        The judge was very clear that the existing Texas “Child Protection Services” and foster care system needed to be abolished, and a new one formed with real reforms.

                                        We also reported how the State of Texas, rather than comply with the judge’s order and make changes to protect Texas children, instead fought back to keep the status quo, as Governor Greg Abbott’s Attorney General, Ken Paxton, chose to fight the decision rather than implement the reforms the court was requiring.

                                        Today, more than 2 years later, it appears that almost nothing has changed in Texas in terms of protecting abused children (even though the State legislature has passed some very nominal reforms), and Judge Jack has ruled again, and ordered Texas officials to adopt almost 100 changes in the Texas foster care system.

                                        Once again, the State of Texas, through State Attorney General Ken Paxton, is resisting these changes.

                                          Texas Mom Blamed for Baby's Accidental Gardasil Vaccine Injuries Fights to Get Medically Kidnapped Daughter Back

                                          The Gardasil vaccine is not intended to be given to children under 9 years of age and has not been studied in babies. It is a vaccine developed for sexually active young women to prevent the humanpapilloma virus and cervical cancer. In recent years, it has been given to teen-age boys as well. It is perhaps the most controversial vaccine in America and around the world today.

                                          Yet when a 4 month old baby in Texas was mistakenly given the shot intended for her teenage brother, her mother has been blamed for causing the symptoms that followed.

                                          Everywhere Anita Vasquez turned for answers for little Aniya’s condition, it seemed that no one she talked to was willing to make the obvious connection between the vaccine and her illness. In the effort to cover-up or deny any effects of the medical error, a family is being sacrificed.

                                          In a cruel twist of irony, the fact that Anita refuses to give up her quest for answers and the fact that she has medical knowledge (because she is a nurse by trade) is being viewed as “evidence” that she has Munchausen syndrome by proxy (or “factitious disorder”) – a rare mental disorder by which someone, usually a parent, intentionally makes a child sick in order to gain attention.

                                          Baby Aniya was seized by Child Protective Services on May 2, 2017, and placed into foster care with strangers.

                                          Her big brother has struggled with blaming himself ever since. He loves his baby sister very much.

                                          In the latest development in their story, CPS social workers have cut off all of 14 year old Alfred’s visits with Aniya.

                                          The Vasquez family just wants to be a family again, but CPS appears to be blaming everyone except the most likely culprit – the vaccine that she never should have received, the vaccine that she was mistakenly given right before her symptoms started.

                                            Father Convicted of Shaken Baby Syndrome 16 Years Ago for Daughter's Death has All Charges Dropped

                                            A father accused of shaking his baby to death has been exonerated, but not until after he spent 16 years of his life in prison for a crime that didn’t happen.

                                            Zavion Johnson of Sacramento, California, was just 18 years old and the oldest of 7 children at the time that a tragic accident happened. He and his wife were parents of 4 month old Nadia. While he was bathing her in the shower, he dropped his baby and she hit her head on the bathtub.

                                            Doctors and investigators testified that the short fall could not have caused her death. They argued that the only explanation was that she had been violently abused. Shaken Baby Syndrome was their verdict.

                                            Zavion Johnson’s devastated family testified in court on his behalf, describing him as loving, gentle, and patient, with plenty of experience in caring for children. They couldn’t believe that he would have intentionally harmed his baby.

                                            After years of fighting as his own attorney (pro se) for his freedom, the Northern California Innocence Project got involved. Evidence was presented showing that there are other scientific explanations for the symptoms of Shaken Baby Syndrome.

                                            The conviction was vacated on December 18, 2017, and Zavion Johnson was released from prison. On January 19, 2018, the prosecution dismissed all of the charges against him.

                                            Zavion Johnson is now a free man, exonerated from a crime that he didn’t commit, a crime that didn’t actually happen.

                                            Not only did he lose his baby girl, he lost his freedom based on a medical theory that is now considered by many to be “junk science.”

                                            How many more innocent fathers, mothers, and caregivers will be sentenced to prison, or lose their children to Child Protective Services, based on the medical myth of Shaken Baby Syndrome?

                                                California Parents Lose Custody of 2-Year Old Daughter When Asking for a Second Opinion Before Removing Child's Kidney

                                                They thought they had the right to get a second opinion. They thought they had the right as parents to have proof of a diagnosis before agreeing to a treatment plan.

                                                When California parents Leah Beabout and Christopher Vega asked for medical evidence before doctors remove their 2 year old daughter’s kidney, the hospital called Child Protective Services and seized custody of their child.

                                                It is the kind of thing that they, like most parents, thought “couldn’t happen in America.”

                                                But as we at Health Impact News have seen and documented, medical kidnappings like this happen regularly all over the United States of America.

                                                According to Leah:

                                                “I brought my daughter Grace Alleluia to the ER on vacation. Two weeks later, she has NO MOTHER, NO diagnosis, NO symptoms other than having lost 2 lbs, a large incision in her belly and a PORT hole in her chest for chemo she might not even need, a catheter in urinary tract, a breathing tube!??”

                                                A child who has never even had a baby-sitter before has been separated from her parents at what may be the most frightening time in her life, the very time that she needs her mommy and daddy the most.

                                                Leah says:

                                                “The hospital just didn’t want us interfering with what they wanted to do and we were asking too many questions.”

                                                As Grace’s parents who love her and want the best for her, Leah and Chris simply wanted:

                                                1. a valid second opinion,
                                                2. the ability to make an informed decision as to treatment plan, including the right to choose the facility to treat her and the course of action to take, and
                                                3. the right to have evidence of a diagnosis before agreeing to treatment.

                                                Do parents no longer have this right? If doctors don’t want to provide these answers to the parents responsible for their child’s care, is the new normal to call Child Protective Services and do the procedures they want to do anyway?

                                                  9th Circuit Court Upholds Parents' Constitutional Rights: Rules Against Arizona Social Workers Removing Children without a Warrant

                                                  In what is seen as a victory for parental rights, the U.S. 9th Circuit Court of Appeals has ruled in favor of Arizona parents who had their 3 children removed from their home simply because they had taken photos of them after a bath when they were laying on a towel naked. They went to develop the photos at a Walmart, and an employee reported them to the police who were called in to investigate.

                                                  The police investigation was extensive, including medical and forensic exams of the children looking for sexual abuse, as well as obtaining a warrant to search the family’s home, where police “seized all the evidence that might be relevant to a child pornography investigation: computers, printers, photographs, cell phones, undeveloped film, floppy discs, DVDs, CDs, VHS tapes, and cameras.”

                                                  Police found no evidence of wrongdoing, so no charges were filed against the parents, and the children were returned home.

                                                  However, Arizona social workers with a participating police detective decided to remove the young children from the home anyway, even without a court issued warrant. The children ended up in foster homes, but then later placed with their grandparents, and eventually returned home.

                                                  The family sued the police detective and settled out of court, but Arizona courts ruled against the family suing the social workers citing state “Qualified Immunity” laws for social workers.

                                                  The 9th Circuit disagreed, ruling that social workers are not above the law, and cannot violate the 4th and 14th Amendments, and that the courts have consistently ruled that families have a “well-elaborated constitutional right to live together without governmental interference.”

                                                    Newborn Kidnapped from Hospital at Birth in Alabama Returned to Parents After 2 Years

                                                    Baby Avyonna was a newborn nursing at her mother’s breast when Alabama social workers seized her from the hospital and placed her into foster care almost 2 years ago. Now, finally, she is home with her parents Haly Boothe and Anthony Lett.

                                                    She was taken by Shelby County Department of Human Resources (DHR) just 3 days after she was born.

                                                    There were no allegations of abuse or neglect. Avyonna was taken because DHR said they had a pick-up order. Social workers believed they had the right to take the new baby since the department already had Haly’s other 2 children Haydn and Ka’Myia in custody.

                                                    During the course of the family’s involvement with DHR, it became clear that the department had been planning all along to adopt Avyonna out. It was never about anything that Haly or Anthony did or didn’t do. It was a foregone conclusion that the people who were adopting her siblings would adopt Avyonna as well.

                                                    It was not until media attention from Health Impact News began to shine the light on what was happening with Shelby County DHR that there was any progress toward getting Avyonna home.

                                                        Tennessee Kidnaps 3 Boys from Mentally Disabled Mom - Refuses Grandmother Custody in Favor of Adoption to Strangers

                                                        A grandmother is fighting to save 2 generations of her family from abuse by the state of Tennessee. Through no fault of her own, her family is being ripped apart, in a terrifying sequence of events that could happen to anyone.

                                                        She is afraid for 3 of her grandsons who were seized by Tennessee Department of Children’s Services (DCS) from their mentally disabled mother. They have suffered horrific abuse in foster care. Now the state is attempting to sever all family ties so that they can adopt them out to strangers.

                                                        She is also fearful for the life of her 33 year old daughter Tara, the boys’ mother, whose mental illness became much worse after the boys were taken. When they learned of the abuse of the boys in foster care, the sense of utter helplessness to protect them pushed her daughter over the edge.

                                                        The law provides for families to do what families do – for those members who are capable to step in and help other family members who are incapacitated in some way.

                                                        However, in this family’s case, the state seems determined to keep that from happening.

                                                        The State of Tennessee has cut off all contact between the boys and their family, accusing the grandmother of not being “objective” because she believes that Tara would get better if she had a relationship with her children, and because she does not trust DCS and has repeatedly said that DCS “stole” her grandsons.

                                                        In addition, the State wants to remove her as her daughter’s conservator (guardian) and place her custody under the custody of a mental health doctor instead, thereby opening the door to remove all of her parental rights so they can adopt out her children.

                                                          In a dramatic turn of events, an Oregon judge has ruled that the children of Amy Fabbrini and Eric Zeigler must be returned home. They were taken by Child Protective Services on the grounds that their parents’ IQ was too low to parent.

                                                          There was no abuse. No neglect. There were only allegations by social workers that they were not clever enough to be parents of their own children.

                                                          The boys, ages 4 and 10 months, were each seized within days of their births. The state had every intention of terminating their parents’ parental rights and adopting them out.

                                                            Parents living in Nevada want their children back home. The children who were taken out of Nevada by Arizona social workers claim they have been abused in Arizona foster care, and want to go back to their parents. They even filed their own lawsuit, the first ever in Arizona, but an Arizona court has ruled against them.
                                                            An Arizona appeals court has denied the parental rights of Nevada residents Jeff and Tabitha Shoars. Almost 17 months ago, Child Protective Services from Arizona crossed state lines and seized 6 of their children from Las Vegas, Nevada.

                                                            All along, they have hoped and prayed for the justice which they felt would surely occur if only judges looked at the actual evidence instead of the hearsay and lies from social workers from Arizona Department of Child Safety (DCS).

                                                            Instead, like so many other parents who have fought Arizona DCS, they were devastated to hear yet another court deny them their parental rights to the children they brought into the world.

                                                              Arizona Girl Raped and Burned in Foster Care Still Represented by Same Attorney - Kept Away from Family

                                                              An Arizona court decided this week that a woman accused of scalding a little girl alive and burning over 80% of her body will go to trial in October 2018. Meanwhile, Samantha Osteraas is out on bail, and the little girl’s biological mother is still trying to get justice for her daughter, whose life was destroyed by Child Protective Services and the adults the agency placed her with.

                                                              While Samantha Osteraas is free to walk the streets as she awaits trial, little Devani’s real family has no idea where she is or who the agency has placed her with this time.

                                                              The court-appointed attorney chosen to represent little Devani and allowed her to remain in foster homes where she was allegedly raped, sexually trafficked, and burned, is the same attorney still representing her today.

                                                              The foster parents who committed such atrocities are now answering for their criminal acts in the legal system, but the government agencies that placed her there and kept her there until today, are apparently not being held responsible for their parts in these heinous crimes.

                                                                The fight to get court-appointed guardians and attorneys to allow 69 year old Beverley Finnegan to receive life-saving medical treatment has ended with her death just before noon on Friday, January 5, 2018.

                                                                Her tragic death follows the one day that her sister and advocate Janet Pidge were not able to be by her side at Framington Union Hospital due to a brutal snowstorm.

                                                                Beverley’s condition was largely unchanged during the last several weeks, so the Friday morning phone call came as a shock.

                                                                Family attorney Lisa Belanger calls it “euthanasia” – the hastening of Beverley Finnegan’s death. Belanger attempted to file a criminal complaint on Saturday, since euthanasia is illegal in Massachusetts. However, the police denied her request, telling her to file medical malpractice instead.

                                                                This woman who was functional, in full control of her mind, and able to walk and care for herself on her own just a few months ago is gone – another victim of guardianship, which allowed police to physically break down the door to her condo and admit her to a psych ward against her wishes and the wishes of her family.

                                                                What really happened to Beverley Finnegan – both in the nursing home before her hospitalization and in the hospital during the snowstorm, during the time that her sister could not watch over her and try to protect her?

                                                                  Child Seized for Medical Marijuana in Oregon Returned Home After Public Outcry

                                                                  Last weekend, the New Year rang in with smiles and tears of joy for an Oregon couple accused of child neglect over a legal medical marijuana harvest and a mother’s mental health. Kitrina’s daughter, Kaylynn, was returned home by Oregon Child Protective Services, the day before the Holiday weekend.

                                                                  The only reason Kaylynn was returned home was because Kitrina Nelson fired her court appointed public defender, Cole Sahleen.

                                                                  Like hundreds of other families who have told their stories to Health Impact News, Kitrina found that the court appointed attorney wanted her to play along while he made a pretense of advocating for her.

                                                                  Regardless of her limited knowledge of the law and court proceedings, and with a little guidance from the judge, who expressed surprise at the crowd of people that showed up to view the court proceedings, Kitrina successfully represented herself and cross examined her own case. After more than 3 hours of testimony and evidence, Judge Hung ruled that the state had no case against her, and that Kaylynn was to be returned home.

                                                                        UPDATE: Family Fights for the Life of Senior Medically Kidnapped from her Home and Forced onto Drugs

                                                                        The fate of 69 year old Beverley Finnegan of Massachusetts remains up in the air for now. Attorneys met on the Friday before Christmas to argue for and against pulling the plug on the medically kidnapped senior citizen.

                                                                        After several hours in court, attorney Lisa Belanger told Health Impact News that they had expected Judge Mareen Monks to rule by the end of the day on Friday, December 23, 2017.

                                                                        That didn’t happen. The verdict was not handed down until after Monday’s Christmas holiday.

                                                                        The ruling is a temporary victory for Beverley’s life. The court requires additional information and will appoint a Guardian ad litem to gather information on the motions submitted by both sides. The next court hearing will be on January 29, 2018.

                                                                        While attorneys and guardians argued in court Friday that Beverley Finnegan should be put to death by “pulling the plug,” attorney Lisa Belanger fought valiantly to save the life of a woman that Dr. Paul Byrne, a medical expert on brain death, says is reasonably likely to improve if she were to have proper treatment:

                                                                        Beverly has a functioning brain. Beverly Finnegan does not fulfill any set of “brain death” criteria.

                                                                        In Dr. Byrne’s medical affidavit, he states that proper medical treatment of her condition did not occur and still has not occurred. He asserts that if she were to receive the proper treatment, there is a “reasonable likelihood of improvement” of her condition.

                                                                            It is Christmas Eve, and the Schwab children were supposed to be home for Christmas. They are not.

                                                                            Earlier this month, a judge assured Navy Veteran Raymond Schwab and his wife Amelia that their children would be coming home in time for the holidays, but in a heart-wrenching turn of events, efforts to get them home have been thwarted by the children’s attorney ad litem.

                                                                            The role of the ad litem is to advocate for “the best interest of the children,” but the children have called their mother in tears because their foster parents told them that they aren’t going home. They obviously don’t agree with their court-appointed representative about what constitutes their best interest.

                                                                            They were never abused or neglected at home, but there is a great deal of evidence that they have suffered abuse in foster care.

                                                                            Now their Christmas hopes of being home and together again have been cruelly dashed.                                                                               What This Homeless Woman Taught Me About Life Today

                                                                              It was the day before Christmas Eve, and as I drove to a city where I was to meet my sons for lunch, it was hard to find a parking spot, as so many people were out and about on the last shopping day before Christmas.

                                                                              Everyone seemed to be in a good mood in this upscale downtown area where I was meeting my sons for lunch. Many were dressed in their holiday best, and there were families everyone; children giddy with glee as they undoubtedly were looking forward to opening presents soon.

                                                                              Since I had to park quite far away from the restaurant where I was to meet my sons, I had a few blocks to walk.

                                                                              At one corner, a woman who was sitting down by herself and talking caught my eye for just a moment. She was on the other side of the street, so I did not get a close look at her.

                                                                              “Why is she talking when she is all alone?,” I quickly thought, but I was late for lunch and I pushed the thought to the back of my mind thinking “she probably has an earbud on and is talking on the phone to someone.”

                                                                              Later, as we were finishing up our lunch on a table that was outside in front of the restaurant (the restaurant was very busy, and the only table available was outdoors as it was quite cold out), a woman walked by that caught my eye.

                                                                              She was not neat – she was dirty, carrying a backpack, smoking a small stub of a cigarette that I guessed someone had discarded, and had multiple layers of clothing and jackets on, well worn and dirty. I later learned she was in her mid 40s, but she looked older than that.

                                                                              She noticed me looking at her, and said to me: “God bless you! Jesus has redeemed me, and God is the God of second chances.”

                                                                              I replied: “Amen! He certainly is the God of second chances. God bless you too.”

                                                                              We began a short conversation, and I was waiting for and expecting the imminent request for money – but it never came.

                                                                                  Active Senior Medically Kidnapped from her Home and Forced onto Drugs in Nursing Home Now Near Death

                                                                                  Earlier this year, Beverley Finnegan, age 69, of Newton, Massachusetts, could walk, talk, and discuss the events from the daily newspaper. That was before she was seized from the condo that she shared with her sister.

                                                                                  Police and “Elder Protective Services” social workers literally broke down her door to enter her residence, and then forced her into a nursing home, and drugged her against her will.

                                                                                  Years before, she had named her sister as her medical proxy, but the state of Massachusetts has ignored her wishes and placed her under guardianship with strangers.

                                                                                  Her whole life, everything she had ever known, was gone with the stroke of a judge’s pen.

                                                                                  Now, she is on life support, and on Monday, December 18, guardians and their attorneys petitioned the court in the attempt to have Beverley Finnegan euthanized.

                                                                                    56 Year Old Man Enters Hospital with Shoulder Pain - Dies 6 Weeks Later After Developing Infection in Hospital

                                                                                    The following is a true story that is, unfortunately, typical of the dangers in being admitted into hospitals today in the U.S.

                                                                                    Carl was a fighter, a survivor. Nothing was handed to him in life.

                                                                                    When he was 15, both his father and mother walked out on him and his younger brother, leaving Carl alone to raise his sibling. Somehow, the two of them managed to earn enough money to keep paying the mortgage and save the family home.

                                                                                    Carl was a handyman, seemingly able to fix anything. He went on to become a master plumber. He was a tall man (over 6 feet tall), and always seemed to turn up anytime someone was in need and could benefit from his services.

                                                                                    When Carl started experiencing shoulder pain in his rotator cuff, one of his friends eventually convinced him to go have it checked out. Carl was not one to visit doctors or seek medical care, and he would have rather endured the shoulder pain than ask for pain medication.

                                                                                    But his friend was insistent, so for her sake he begrudgingly agreed to be taken to the hospital, as he had been lying in bed with pain for so many days, that now his hip was starting to bother him also.

                                                                                    Tragically, after the hospital admitted him, he soon developed pneumonia, and a Methicillin-resistant Staphylococcus aureus (MRSA) infection.

                                                                                    6 weeks later he was dead. Carl’s friends watched their friend who entered the hospital system due to chronic shoulder pain be tortured and killed by the hospital, and they were powerless to do anything about it.

                                                                                      Massachusetts State Auditor Finds Widespread Rape and Sexual Abuse in Foster Care but DCF Officials Won't Report It

                                                                                      On December 7, 2017, Massachusetts State Auditor Suzanne Bump released an appalling audit of her state’s Child Protective Services, the Department of Children and Families (DCF).

                                                                                      The audit, which covered 2014 and 2015, found that there were many instances where children in state care, whether in foster homes or group homes or other facilities under DCF care, were abused physically or sexually, but DCF failed to report the incidents to the proper authorities.

                                                                                      DCF officials told Auditor Suzanne Bump that they don’t see sexual abuse as a serious enough problem that they need to report it.

                                                                                        18 Year Old Wrongly Convicted of Shaken Baby Syndrome Set Free After Serving 17 Years in Prison

                                                                                        Thanks to new scientific knowledge about Shaken Baby Syndrome, a man wrongfully convicted in 2002 of killing his 4-month-old daughter has had his conviction reversed after spending nearly 17 years in prison.

                                                                                        The San Francisco law firm Keker, Van Nest & Peters and the Northern California Innocence Project (NCIP) at Santa Clara University School of Law brought forth the new evidence, which reflects updated knowledge about the causes of Shaken Baby Syndrome and the risk of parents improperly being charged with murder in cases of household accidents.

                                                                                        The California Superior Court of Sacramento reversed Zavion Johnson’s murder conviction, which occurred when he was 18 years old. In what he has always claimed was a tragic accident, Johnson’s daughter, Nadia, slipped from his arms and fell in the bathtub while Johnson was bathing her. She later died from internal injuries.

                                                                                        Despite 15 witnesses including Nadia’s mother, testifying that Johnson was a loving, caring father, medical experts at the time cited the then-medical consensus that the only possible explanation for Nadia’s injuries and death involved Shaken Baby Syndrome.

                                                                                        Jurors called the medical evidence “overwhelming,” and sentenced him to life in prison, even though, as one juror recollected, they “felt that Zavion Johnson was a good young man, very loving to his girlfriend and their baby girl, and that it would seem horribly out of character for him to murder his baby.” The juror went on the say, “without that evidence, we certainly would not have convicted Zavion Johnson.”

                                                                                        Using modern science, medical experts, including the original pathologist that testified at Johnson’s trial, have since reviewed the case. The experts agree that Nadia’s injuries are consistent with the fall originally described by Johnson 17 years ago and they can no longer say it was abuse.

Oregon has issued permits for the medicinal use for marijuana since 1998 and legalized recreational use since 2014.

                                                                                            The couple has complied with all state laws, and they don’t understand how the same state can legalize something on one hand while on the other hand, they seize a child from her home for the very thing that the legislators and voters have said that they can do.

                                                                                            This murky and confusing legal climate has left a mother devastated and her baby girl robbed of her family.

                                                                                            No matter what one believes about the legalization, use, or ethics of marijuana, it is clear that families should not be torn apart over differing policies within the same state agencies.

                                                                                              Nyhariah Mack’s battle to live has ended. She passed away Thursday afternoon, December 7, 2017. The little girl with a very rare chromosomal disorder was full of life when a doctor and hospital enlisted Georgia’s Child Protective Services to seize her from her mother a year and a half ago.

                                                                                              At the time, she had no issues, just a rare medical condition that made her tiny and delayed her development. Shortly after going into “protective” custody, her health rapidly declined. She was subjected to unnecessary, experimental surgeries.

                                                                                              Many family, friends, and supporters believe that the doctors and hospital at Emory took her in order to experiment on her, since her condition was so rare – only a little over a hundred people worldwide have the diagnosis of Trisomy 9.

                                                                                              Her tonsils were removed only a couple of weeks after she was seized, providing tissue that scientists were free to use in experiments. What else might they have done to this little girl behind closed doors?

                                                                                              It has been apparent to her mother since the beginning that there were some within this whole ordeal that saw her child as nothing more than a guinea pig, a lab rat to be used for scientific experimentation.

                                                                                                All states are federally-mandated to have some type of citizen review panel for Child Protective Services cases, but a recent decision by Arizona’s Department of Child Safety Director Greg McCay will move that citizen review panel in Arizona in-house, within the Department of Child Safety, by the end of the year.

                                                                                                Presumably, a citizen review panel is designed to provide some level of accountability to the Child Welfare/Foster Care system, allowing for an objective third party to evaluate cases and ensure that parents’ rights are not being violated and that children are truly being protected.

                                                                                                Critics and parents fear that Arizona’s move to in-house review panels will only serve to further insulate corrupt officials and lead to less, not more, oversight and accountability of the Department.

                                                                                                  Enraged Idaho Community Acts to Help Young Couple Who Refused Vaccine for Newborn - Baby Back Home for Now

                                                                                                  An Idaho newborn who was seized by Child Protective Services the day before Thanksgiving over vaccine refusal was conditionally returned to his parents on Friday, December 1.

                                                                                                  While supporters are rejoicing over the judge’s decision, there is a great deal of concern over the state of Idaho’s overreach in taking baby Elijah. Precious bonding time was lost, and a new family has been traumatized.

                                                                                                  Diamond Mehlhoff has cerebral palsy, which is a brain disorder affecting movement. Despite her disability, she is active and involved in her church. She lives with her husband Ari and the baby’s grandfather.

                                                                                                  For the Mehlhoff family, they have won a temporary victory. Their baby is now home with them. Their church family has rallied around them and will be providing round-the-clock support.

                                                                                                  Like every other family that comes under the heavy hand of Child Protective Services, the couple will have to jump through hoops as they prepare for the next court hearing.

                                                                                                    Nevada Rules Against Arizona CPS on Shoar Family Baby - Remaining Children Still Held as Prisoners in Arizona Foster Care

                                                                                                    Jeff and Tabitha Shoars are rejoicing today over a Nevada court’s ruling. The Child Protective Services’ claims against them that originated in Arizona, not Nevada, have been found to be unsubstantiated, and the case is closed as of 10 a.m. on November 30, 2017.

                                                                                                    Despite repeated attempts by social workers from the State of Arizona to have their baby Ny’tallieya removed from her parents’ custody, a Nevada court has found that there are no reasons to keep the baby from her home.

                                                                                                    Tabitha Shoars says that they are very excited, and that it feels “like a weight’s been lifted off of [their] shoulders.”

                                                                                                    This is the 4th time that Arizona has presented false allegations against them to the state of Nevada, and it is the 4th time that the allegations were found to be unsubstantiated.

                                                                                                    The Shoars are hopeful that this will signal to Arizona social workers that they cannot manipulate social workers and courts in other states. She says that one of the Nevada social workers they have worked with clearly sees that the Arizona CPS attacks against them are “harassment.”

                                                                                                    The fight continues, however, to get their other 7 children back from the state of Arizona, where they remain held captive in foster care. Arizona social workers traveled to Nevada last year and kidnapped the Shoars’ children, bringing them back to Arizona. Baby Ny’tallieya was the only one spared at that time, because she was born in Nevada and local officials would not help Arizona kidnap her.

                                                                                                    The Shoars’ 7 children held prisoner in Arizona foster care have been traumatized and desperately want to return home to their parents in Nevada. They have filed a lawsuit in Arizona demanding justice.

We were notified by the daugther of a local pastor here in Kootenai County regarding a woman of his congregation, Diamond Mehlhoff, who gave birth in Kootenai County @ KMC on Monday November 20th via C section.

                                                                                                        On Wednesday November 22nd, after the parents refused vaccination for the baby, the state became involved and took this beautiful baby, Elijah, from his loving parents, claiming the mother to be unfit due to a diagnosis of cerebral palsy (a non progressive movement disorder).

                                                                                                        Their court hearing is tomorrow, Monday 27th at 8am @ 205 N 4th Street Coeur D Alene ID 83814 in the Juvenile Justice Center. They are asking anyone available to please come support them.

                                                                                                          Today is a holiday of “Thanksgiving” for many people in the United States.

                                                                                                            One of the dirty little secrets of Child Protective Services is that children are sometimes taken from their homes, and their parents’ rights ended, simply because the children are “adoptable.”

                                                                                                            Now, in a stunning reversal of a termination of parental rights decision, a Court of Appeals has concluded that the Arizona Department of Child Safety (DCS) took children from their mother primarily because her children were considered adoptable.

                                                                                                                The story of Baby Braelon in Alabama went viral during the summer of 2016, reaching a million people in just the first 24 hours. The baby boy was born to a 14 year-old mother who was a rape victim. When Braelon was born, his grandmother Dee became concerned that DHR was going to try something to take the baby away from his young mother, whom Dee and Rodney had raised since infancy.

                                                                                                                  How the Elderly Lose Their Rights: Guardians can sell the assets and control the lives of senior citizens without their consent—and reap a profit from it.

                                                                                                                  In the United States, a million and a half adults are under the care of guardians, either family members or professionals, who control some two hundred and seventy-three billion dollars in assets, according to an auditor for the guardianship fraud program in Palm Beach County.

                                                                                                                  Little is known about the outcome of these arrangements, because states do not keep complete figures on guardianship cases—statutes vary widely—and, in most jurisdictions, the court records are sealed.

                                                                                                                  A Government Accountability report from 2010 said, “We could not locate a single Web site, federal agency, state or local entity, or any other organization that compiles comprehensive information on this issue.”

                                                                                                                  A study published this year by the American Bar Association found that “an unknown number of adults languish under guardianship” when they no longer need it, or never did. The authors wrote that “guardianship is generally “permanent, leaving no way out—‘until death do us part.’ ”

                                                                                                                    Will Everyone in the U.S. Soon Need Government Approval to be Parents and Keep Their Children?

                                                                                                                    Children belong to their parents.

                                                                                                                    Such a concept is foundational to every culture throughout all of human history. The family is the core group of any society. The need of the child for his or her own parents is a need that impacts the child on every level: biologically, psychologically, emotionally, spiritually, developmentally, and culturally.

                                                                                                                    In most circles, the truth of the above statements is accepted as common knowledge.

                                                                                                                    However, there are some who do not hold to these most cherished values of family and kinship. Unfortunately, some of these people are radicals and extremists who hold positions of great influence over public policy, which translates into very real problems for families.

                                                                                                                    Richard Wexler, Executive Director of the National Coalition for Child Protection Reform, wrote of some radical views of the family by Elizabeth Bartholet, who is a Professor of Family Law at Harvard Law School:

                                                                                                                    “Bartholet’s ideas are so extreme that they include requiring every family with a young child to open itself to mandatory government surveillance.”

                                                                                                                    Bartholet has worked with another radical whose views we have exposed here at Health Impact News, Professor James Dwyer of William and Mary College. Dwyer believes that there is no inherent right to parent one’s own children, and has stated:

                                                                                                                    “The reason that parent-child relationship exists is because the state confers legal parenthood on people through its paternity and maternity laws.”

                                                                                                                    One of Dwyer’s books was even the required text for a course on Family Law that Bartholet taught.

                                                                                                                    If these law professors’ radical views were isolated and contained to a few classes and lectures attended by a handful of elite college students, their views might be dismissed as irrelevant to most of us.

                                                                                                                    However, both Dwyer and Bartholet appear to have a great deal of influence over public policy, and their views trickle down to the very people who have the power to make the equivalent of life-and-death decisions over families.

                                                                                                                    These radical views that supplant parental rights in favor of government control of children are behind many of the Medical Kidnap stories we publish.

                                                                                                                      Teen Girls Abused in State Care in Michigan Seized Again in Florida After Insurance Refuses to Cover Treatment

                                                                                                                      A battle to get insurance to cover necessary medical care for teenage sisters with bulimia nervosa has ended up with those teens being taken by Child Protective Services in Florida. Their mother is asking how it can be that an insurance company is able to direct CPS to remove children from their homes.

                                                                                                                      The Florida Department of Children and Families (DCF) has accused Laura Dalton of “medical neglect,” but the evidence provided to Health Impact News demonstrates that she is a dedicated mother who has been working tirelessly to secure the proper treatment for her daughters. In fact, one of the twins was seized from the hospital, where her mother had taken her the week before due to her dangerously low blood pressure and pulse.

                                                                                                                      The twins have suffered eating disorders after they were put into foster care in Michigan, where they were allegedly abused. They were healthy girls prior to that time, but as a penalty for allegedly smoking marijuana one time, they were removed from their home, and that is when their real problems began.

                                                                                                                      Both girls almost died in state care in Michigan, before their mother was able to get them back home. Once home, their mother looked for help for their eating disorders, and eventually found treatment options for them in Florida.

                                                                                                                      Statistics show that children who have been in foster care are 7 times more likely to develop bulimia and other eating disorders. Foster children are more likely to develop PTSD than veterans of war.

                                                                                                                      But now, after being recommended for a treatment plan that has showed great promise for the girls, their insurance will not cover it, and the mom has been reported to CPS for medical neglect.

                                                                                                                      One of the twins was immediately seized from the hospital, as the family’s nightmare has begun all over again.

                                                                                                                          Comments by Brian Shilhavy, Health Impact News Editor: I have been investigating and covering the topic of vaccines for over a decade now, and know the topic so well that seldom, if ever, can I find anyone to carry on an intelligent conversation about the topic.

                                                                                                                          The controversial topic of vaccines in the U.S. today is primarily a topic about beliefs, and people’s trust in vaccines resembles a religious belief, not an informed opinion based on the facts.

                                                                                                                          I am not sure in all of my years in covering this very important and very controversial topic, that I have ever found a literary treatise on the subject as eloquent and comprehensive as this piece just put together by Barbara Loe Fisher, the founder of the National Vaccine Information Center.

                                                                                                                          Revolutions that have changed the course of history have begun on lesser documents and exposés than what Barbara has written here, and I am not exaggerating.

                                                                                                                          When discussing the topic of vaccines, the religious-like faith of those who put their trust in them usually starts out with a statement like: “When it comes to vaccines, the science is settled.”

                                                                                                                          This statement in and of itself is intrinsically unscientific, and is simply used to avoid debate and censor any information contrary to the religious-like beliefs so many hold about vaccines.

                                                                                                                          Fisher correctly points out how our modern day culture has come to worship “science,” but it is a very perverted form of true science.

                                                                                                                          Fisher does an excellent job also of documenting the history of “eugenics,” which was born in American intellectualism and made notorious by Hitler in Nazi Germany to justify horrible atrocities.

                                                                                                                          As we have reported here at Health Impact News, while the term “eugenics” has become unpopular, the ideas it represents have never left American culture – they have just been “repackaged” and are the same arguments used today for forced vaccination as they were used in the past for forced sterilization.
