2 Children Awarded $1.1M From Medical Kidnap Case

Two children removed from their home in San Diego by county social workers will receive more than a million dollars as part of a settlement deal. The two children were apparently injured at a daycare center, and when a doctor reported the daycare center, social workers showed up at the home instead and abducted the children, performing their own physical exam of the children without parental approval. A judge ruled taking the children away was unconstitutional since a call to the day care would have confirmed the injuries happened there. The county's physical exam of the two children was also deemed unconstitutional and the consent forms inadequate.

Breastfeeding Mother Arrested and Babies Taken Away by Force: The Parents’ Side of the Story

The police literally ripped 14 month old Levi from his mother's breast, reports Erica May Carey, as she was nursing him in the car at a California gas station. Her baby was screaming, and she says her breast was exposed as the officers dragged her from the car. As she recounted the events of last Thursday, Erica began weeping, saying that she was "hogtied like an animal, when moments before I was nursing my infant." She was arrested and jailed for fighting to keep her children with her, she tells Health Impact News. Filmmaker Was Documenting Abuses in CPS and Children Murdered under State Custody Before He Died

In 2009, Bill Bowen released a trailer for a documentary film he was producing exposing the corruption within Child Protection Services across the United States. The film is called Innocence Destroyed. On why he undertook the project to produce this film, Mr. Bowen said: "I decided to dedicate my life to the exposing of one of the worst criminal activities in the history of this country, in my opinion. Federal Lawsuit: Massachusetts Wrongly Took Child 2 Days After Birth Because Mother was Disabled

Two days after giving birth to her daughter, the state took away 19 year old Sara Gordon's baby because Sara has a developmental disability, and placed her baby in foster care. The federal government says the state violated her civil rights by discriminating against her because of her disability. The National Council on Disability, an independent federal agency advising the White House and Congress, says the case points up a growing problem: states needlessly taking custody of the children of disabled parents. "Parents with disabilities are suffering significant discrimination," said Robyn Powell, an attorney for the council. "What happened to this mother is very common ... States are removing these children for the sole reason of their parents having a disability."

Lawsuit in San Antonio Claims CPS is Kidnapping Latin American Babies

The League of United Latin American Citizens filed a federal lawsuit on Feb. 6 against Child Protective Services, alleging the department abused its power. LULAC said that CPS took a 10-day-old baby away from its mother because of alleged drug use. The woman and baby did not test positive for drugs, but CPS still took the baby away. Julie Marquez, with the LULAC Council in Seguin, said the case is nothing out of the ordinary for CPS. “We have several cases ... We have more than 10 cases. It’s the same M.O. over and over and over again. They withhold evidence and they abuse their discretion and they abuse their power,” Marquez said.

Parents Get $800K Over Warrantless Search and Removal of Homeschool Kids Who Were Not Vaccinated

KPCC reported this week that the Los Angeles County Board of Supervisors will pay $800,000 to the parents of two children taken from their home by a Sheriff’s deputy and social workers with the Department of Children and Family Services, who did not obtain a warrant first. According to KPCC, the lawsuit states that the complaint used by DCFS centered around what the homeschooled family chose to feed their children, and for failing to vaccinate them: Social workers with the Department of Children and Family Services claimed the parents “created a detrimental and endangering home environment” for the children by failing to provide nourishing food and immunizations. The lawsuit describes the deputy mocking the parents for not immunizing their children based on religious beliefs and homeschooling them. It accuses him of coercing the parents into a search of their hotel room. “You could lose your kids forever,” he allegedly threatened.

Rengo Family Children Taken Back into State Custody in Washington, As Family Tries to Flee CPS

The Rengos reportedly left their home in Washington to avoid having CPS take their children away again, but on February 5, 2015, they were picked up in California, and the children were taken away from them by force. According to ksbw.com: "Cleve Goheen-Rengo, 23, and Erica Carey, 29, fled from their Washington home with the three children. A warrant was not issued for their arrest, but a Be On The Lookout was issued by Bellingham police to West Coast law enforcement. Bellingham police officers said it was not a criminal kidnapping or Amber Alert investigation, but rather a civil violation by defying CPS court orders." So while no criminal charges were made against the parents, nevertheless, the children will be returned to State custody in Washington. The children seemed OK, according to California authorities. “They didn’t appear to have any obvious injuries or ailments,” (California Highway Patrol officer) Sadek said. Carey (the mother) was arrested for refusing to cooperate with Santa Cruz County law enforcement. She reportedly shouted out: "Send a message to America for me. Children don't belong to the government. The government belongs to the people."

The Associated Press and many other media outlets today (February 3, 2015) have announced that a federal class-action lawsuit was filed against the directors of the Arizona Department of Children's Services and the Department of Health Services by ten foster children in Arizona. The children in the lawsuit are represented by the groups Children's Rights, the Arizona Center for Law in the Public Interest, and Phoenix law firm Coppersmith Brockelman PLC. Arizona's treatment of foster children is so bad it actually puts kids at risk of greater harm, says the federal class-action lawsuit. The lawsuit, which names as plaintiffs 10 foster children ages 3 to 14, said the agencies failed to address ongoing failures. The suit also accuses the state of a "widespread failure to engage in basic child welfare practices aimed at maintaining family relationships." That includes placing siblings together, trial reunifications with parents, adequate visitation between children and biological families, and having caseworkers visit parents to work toward reunification.

Does the State Ever Have a “Right” to Remove Children from a Home?

When does the State have the right to remove children from a home where they are living with their parents? We have been covering medical kidnapping stories now on MedicalKidnap.com for over a year. This website was started to document the many stories that were coming to our attention where families were losing their children to the State, and the foster care system, over medical disagreements. In many of these cases, their children were taken away simply because they disagreed with a doctor, or wanted to take their children to a different doctor to get a second opinion. Does the State have a right to take children away from parents for what is now being called "medical abuse," a term used by medical authorities when parents disagree with doctors, or want to seek a second opinion? Most of the people who follow MedicalKidnap would state "no." And we have published many stories now showing that this is indeed happening all across the country, in every state, every single day. But what about in other situations? Are there any situations where authorities should step in and remove children from their homes, taking them away from their parents? Judging from comments made in social media from many commenting on some of our articles, I think it is safe to assume that the majority of people in the United States today feel that in certain situations, the State has a legitimate right to step in and take children away from their families, removing them from their homes. However, I would like to suggest that the Constitution of the United States of America protects the rights of individuals and families, and that it is never lawful for social services to remove a child from their biological parents, taking them out of their home and making them a ward of the State, removing legal custody from their parents. This phenomena is a recent development in the history of our country, and if it is not lawful to take such actions, we are correct in calling such actions "state-funded kidnappings."
