Disabled Parents Losing Right to Parent their Own Children in America while Foster Parent Recruitment Seeks “Imperfect Parents”

Parents with disabilities face challenges in raising their children. One challenge that many may not have expected, however, is the right simply to BE a parent. A recent article by the Pacific Standard describes the "uphill battle" that parents with disabilities face to keep their own children. The statistics cited are alarming: "Research indicates that parents with disabilities and their families are overrepresented in the child welfare system. While parents with disabilities make up only 6.2 percent of all parents in the United States, a recent study found that 19 percent of children in foster care have a parent with a disability." According to data from the Child Maltreatment report for 2016 from the U.S. Department of Health and Human Services, only about 25% of the children coming into the system are taken for reasons of physical or sexual abuse. Most children placed into the foster care system were not abused. Nationally, only 17.2% of the allegations against parents are even substantiated. Yet, disabled parents are losing their children at a higher rate than the general public. Sometimes, their disability is the sole reason for their children being taken from them. What is worse is that they are less likely to get their children back once the state takes them. All of this violates the Americans with Disabilities Act (ADA). The Ad Council slogan, "You don't have to be perfect to be a perfect parent" is aimed at potential foster and adoptive parents, but it is a slap in the face to real parents who are told by the state that they cannot parent their children because they are less than perfect.

Healthy Boston Woman is Medically Kidnapped and Forced onto Pysch Drugs Resulting in her Death

Another Boston area woman's life has been cut short after elder "protective" services and guardians became involved. The story of Alice Julian's medical kidnapping is shocking and horrifying in that it shows the almost omnipotent power of the state to override the decisions made by a citizen in preparation for their latter years. Alice Julian had a strong will to live. She was described as an "exceptionally healthy" 89 year old woman before being seized and drugged against her will. Her daughter Pamela Julian fought valiantly to save her life, but the strength of a group of Guardians, lawyers, and Jewish Family and Children's Services proved to be too great a hurdle to overcome. She died on the morning of January 9, 2018.

Pediatric Doctor Pleads Guilty to Illegally Targeting Teens for Cholesterol Drug Trials

A Pediatric Cardiologist from Georgia has pleaded guilty to illegally targeting teens for a cholesterol drug that was only approved by the FDA for a rare disorder. According to court documents, Dr. Eduardo Montaña colluded with pharmaceutical company Aegerion to sell their drug Juxtapid to teenagers with heart problems, even though the drug was not approved for their conditions. Dr. Montaña violated HIPAA laws of patient privacy by supplying the pharmaceutical company private medical records of 280 teenagers without patient knowledge or consent. Drug company Aegerion was found guilty of criminal wrongdoing in a Massachusetts court. Juxtapid, which received FDA approval in 2012, costs over $330,000 per patient per year, so the drug company had strong financial motives to expand its sales. Dr. Montaña was a willing accomplice in their criminal activities, and reportedly hoped to get a kickback for himself. He requested a $236,000 grant from Aegerion. In the conviction against Aegerion in this case with Dr. Eduardo Montaña, District Judge William G. Young lamented how the U.S. Government allows criminal pharmaceutical companies to get off so easily, and continue doing business. Existing laws that protect pharmaceutical companies apparently prevented Judge Young from automatically issuing the harshest penalty, as the federal government generally strikes a plea bargain deal with the pharmaceutical company to keep them in business. Judge Young wrote: "What is left unexplained is why the government does not simply let Aegerion collapse in disgrace. Surely Aegerion is not too big to fail."

2 Years After Isaiah Rider Medically Kidnapped: “They Destroyed Our Whole World”

It has been almost 2 years since Isaiah Rider was released from Illinois DCFS custody after being medically kidnapped. Like many families who are reunited after the trauma of dealing with Child Protective Services, Isaiah and his mother, warrior-advocate Michelle Rider, largely withdrew from social media and the public eye. The horrors they had experienced took a toll and they have needed time to heal. They recently shared their story with a reporter from KWIR, a publication whose audience is largely LGBT. Michelle Rider says that she wants their story to be told as a warning for parents. Reporter Gretchen Rachel Hammond writes: "Although not LGBT themselves, Michelle and Isaiah fear for both gay and straight couples who take a child to a hospital like Lurie for help and suddenly find themselves catapulted into a hell they could never have imagined." In the opening of the series, Hammond makes this statement: "As an increasing number of LGBT couples choose to adopt, the story of one of the most disturbing and bizarre cases of DCFS removing a child after hospital doctors claim Medical Child Abuse serves as a warning." The public may not be aware that the LGBT community contributes to the demand for children to adopt. The Rider article series by KWIR serves as a cautionary tale that the children offered up for adoption to LGBT couples, and to anyone else seeking to adopt, are not always "poor abused children in need of a forever home." Adoptive and foster parents are not always told the truth about the children who are placed with them. Far more often than not, the children were taken from families who love them, who never abused them, and who have been falsely accused of hurting their children. Social worker whistleblowers have told us that they are encouraged to seize children who are "adoptable." Adults wishing to adopt children increase the demand, whether they are LGBT couples unable to conceive on their own, infertile couples, couples with good intentions who want to help children, Christian and religious families seeking to care for "the needy and the orphan," or even pedophiles. No matter the motive, whether good or bad, each serves to create the demand for children. As that demand increases, more children are being taken from innocent families in order to supply the commodities (children) to meet the demand. It is simple economics.

Public Warning: Boston is a Cesspool of Adult Medical Kidnappings

Boston is home to one of the first notorious cases of medical kidnapping that garnered widespread public attention, that of Justina Pelletier, seized by Boston Children's Hospital and Child Protective Services, and confined against her will and the will of her family in a psych ward. It appears that the Boston area is a hub for medical kidnappings of adults as well as children. In at least 4 cases that we know of in the Boston, Massachusetts, area, there is a web of common players who are interconnected. Jewish Family and Children's Services is the common denominator for each of these senior citizens who were seized by Adult Protective Services. Instead of foster parents, "guardians" are court-appointed to take control of their lives, assets, and medical decisions, leaving elder adults victims of strangers they have never met, isolated from their family and friends who are the ones that truly care about them. They are accused of having "mental illness" and confined to psych wards against their will. Lonnie Brennan is the editor of a newspaper that has reported their stories, The Boston Broadside. He was recently threatened with arrest for trying to visit one medically kidnapped lady, Mary Frank, who was trying to reach out to him to get her story published. She was confined to a nursing home and psych ward against her will, and denied basic human rights. Her perpetrators did not want her story going public. Lonnie told a local radio talk show host: "Once they have you, you are better off going to the nearest liquor store and saying, 'Hey, I'm robbing you.' Because you'll get better health care and you'll get better freedom if you are in prison. I hate to say it. And you'll have more dignity in prison than you will have - than we have witnessed - in nursing homes."

Florida Dad Wrongfully Convicted for Shaking Baby and Served 20+ Years of a 70 Year Sentence Featured on CNN

On February 17, 2018, CNN aired a Special Report titled "Broken Bones, Shattered Lives" which featured the story of James Duncan, who was convicted of child abuse for shaking his son who was an infant at the time. He has served over 20 years of a 70 year conviction for a crime he claims never happened. A Florida appeals court has agreed to re-try the case. CNN's Jean Casarez interviewed James' ex-wife and two sons (now adults) for the report, and they all maintain that James is innocent. Jean Casarez also interviewed Dr. David Ayoub, a radiologist and expert on infantile rickets who stated: "It's a bad diagnosis." He said he believes Kody had infantile rickets, a disease of early life in which bones do not mineralize properly. Ayoub said it led Kody to develop metabolic bone disease, causing his bones to be very fragile. When Jean Casarez asked Dr. Ayoub how many parents he thought might be incarcerated today wrongfully on charges of Child Abuse for shaking their child, he replied "In the tens of thousands."

The state of Arizona, which has the infamous reputation of removing the highest percentage of children in the U.S. from their homes and families through Child Protective Services, has now also been exposed as having a very corrupt foster care network that includes pedophile rings where young children are imprisoned in state-approved foster homes and trafficked to pedophiles. In a developing story based out of the military town of Sierra Vista, Arizona, the home of Fort Huachuca, David Frodsham, a former commander with the Department of Defense in Afghanistan who was discharged from duty due to “sexual harassment” behavior and an assessment by the military that he had an unalterable personality disorder, has been arrested and convicted of operating a pornographic pedophile ring based out of his state-approved foster home. Health Impact News first reported on the charges brought against David Frodsham and his wife who were state-approved foster parents last year with the story of the young child Devani, who was seized from her family just days before her second birthday and placed into the Frodshams' state-approved foster home where she was allegedly raped repeatedly and trafficked as part of an organized pornographic pedophile ring. After David Frodsham was arrested due to a federal investigation, Devani was placed into another state-approved foster home where 80% of her body was burned by scalding water, forcing the amputation of some of her toes. Texas Judge: CPS Still Unconstitutional – Foster Care Sexual and Physical Abuse Still the Norm

Two years ago (January 2016) Health Impact News reported that U.S. District Judge Janis Graham Jack had ruled against the State of Texas stating that the foster care system, named in a class action lawsuit on behalf of Texas foster children, was unconstitutional. In her 255 page ruling, Judge Jack wrote: "Texas’ PMC (Permanent Managing Conservatorship) children have been shuttled throughout a system where rape, abuse, psychotropic medication, and instability are the norm." The judge was very clear that the existing Texas "Child Protection Services" and foster care system needed to be abolished, and a new one formed with real reforms. We also reported how the State of Texas, rather than comply with the judge's order and make changes to protect Texas children, instead fought back to keep the status quo, as Governor Greg Abbott's Attorney General, Ken Paxton, chose to fight the decision rather than implement the reforms the court was requiring. Today, more than 2 years later, it appears that almost nothing has changed in Texas in terms of protecting abused children (even though the State legislature has passed some very nominal reforms), and Judge Jack has ruled again, and ordered Texas officials to adopt almost 100 changes in the Texas foster care system. Once again, the State of Texas, through State Attorney General Ken Paxton, is resisting these changes.

Texas Mom Blamed for Baby’s Accidental Gardasil Vaccine Injuries Fights to Get Medically Kidnapped Daughter Back

The Gardasil vaccine is not intended to be given to children under 9 years of age and has not been studied in babies. It is a vaccine developed for sexually active young women to prevent the humanpapilloma virus and cervical cancer. In recent years, it has been given to teen-age boys as well. It is perhaps the most controversial vaccine in America and around the world today. Yet when a 4 month old baby in Texas was mistakenly given the shot intended for her teenage brother, her mother has been blamed for causing the symptoms that followed. Everywhere Anita Vasquez turned for answers for little Aniya's condition, it seemed that no one she talked to was willing to make the obvious connection between the vaccine and her illness. In the effort to cover-up or deny any effects of the medical error, a family is being sacrificed. The Vasquez family just wants to be a family again, but CPS appears to be blaming everyone except the most likely culprit - the vaccine that she never should have received, the vaccine that she was mistakenly given right before her symptoms started.

Father Convicted of Shaken Baby Syndrome 16 Years Ago for Daughter’s Death has All Charges Dropped

A father accused of shaking his baby to death has been exonerated, but not until after he spent 16 years of his life in prison for a crime that didn't happen. Zavion Johnson of Sacramento, California, was just 18 years old and the oldest of 7 children at the time that a tragic accident happened. He and his wife were parents of 4 month old Nadia. While he was bathing her in the shower, he dropped his baby and she hit her head on the bathtub. Doctors and investigators testified that the short fall could not have caused her death. They argued that the only explanation was that she had been violently abused. Shaken Baby Syndrome was their verdict. Zavion Johnson's devastated family testified in court on his behalf, describing him as loving, gentle, and patient, with plenty of experience in caring for children. They couldn't believe that he would have intentionally harmed his baby. After years of fighting as his own attorney (pro se) for his freedom, the Northern California Innocence Project got involved. Evidence was presented showing that there are other scientific explanations for the symptoms of Shaken Baby Syndrome. The conviction was vacated on December 18, 2017, and Zavion Johnson was released from prison. On January 19, 2018, the prosecution dismissed all of the charges against him. Zavion Johnson is now a free man, exonerated from a crime that he didn't commit, a crime that didn't actually happen. Not only did he lose his baby girl, he lost his freedom based on a medical theory that is now considered by many to be "junk science." How many more innocent fathers, mothers, and caregivers will be sentenced to prison, or lose their children to Child Protective Services, based on the medical myth of Shaken Baby Syndrome?

California Parents Lose Custody of 2-Year Old Daughter When Asking for a Second Opinion Before Removing Child’s Kidney

They thought they had the right to get a second opinion. They thought they had the right as parents to have proof of a diagnosis before agreeing to a treatment plan. When California parents Leah Beabout and Christopher Vega asked for medical evidence before doctors remove their 2 year old daughter's kidney, the hospital called Child Protective Services and seized custody of their child. It is the kind of thing that they, like most parents, thought "couldn't happen in America." But as we at Health Impact News have seen and documented, medical kidnappings like this happen regularly all over the United States of America. According to Leah: "I brought my daughter Grace Alleluia to the ER on vacation. Two weeks later, she has NO MOTHER, NO diagnosis, NO symptoms other than having lost 2 lbs, a large incision in her belly and a PORT hole in her chest for chemo she might not even need, a catheter in urinary tract, a breathing tube!??" A child who has never even had a baby-sitter before has been separated from her parents at what may be the most frightening time in her life, the very time that she needs her mommy and daddy the most. Leah says: "The hospital just didn't want us interfering with what they wanted to do and we were asking too many questions." If doctors don't want to provide these answers to the parents responsible for their child's care, is the new normal to call Child Protective Services and do the procedures they want to do anyway?

9th Circuit Court Upholds Parents’ Constitutional Rights: Rules Against Arizona Social Workers Removing Children without a Warrant

In what is seen as a victory for parental rights, the U.S. 9th Circuit Court of Appeals has ruled in favor of Arizona parents who had their 3 children removed from their home simply because they had taken photos of them after a bath when they were laying on a towel naked. They went to develop the photos at a Walmart, and an employee reported them to the police who were called in to investigate. The police investigation was extensive, including medical and forensic exams of the children looking for sexual abuse, as well as obtaining a warrant to search the family's home, where police "seized all the evidence that might be relevant to a child pornography investigation: computers, printers, photographs, cell phones, undeveloped film, floppy discs, DVDs, CDs, VHS tapes, and cameras." Police found no evidence of wrongdoing, so no charges were filed against the parents, and the children were returned home. However, Arizona social workers with a participating police detective decided to remove the young children from the home anyway, even without a court issued warrant. The children ended up in foster homes, but then later placed with their grandparents, and eventually returned home. The family sued the police detective and settled out of court, but Arizona courts ruled against the family suing the social workers citing state "Qualified Immunity" laws for social workers. The 9th Circuit disagreed, ruling that social workers are not above the law, and cannot violate the 4th and 14th Amendments, and that the courts have consistently ruled that families have a “well-elaborated constitutional right to live together without governmental interference.”

Newborn Kidnapped from Hospital at Birth in Alabama Returned to Parents After 2 Years

Baby Avyonna was a newborn nursing at her mother's breast when Alabama social workers seized her from the hospital and placed her into foster care almost 2 years ago. Now, finally, she is home with her parents Haly Boothe and Anthony Lett. She was taken by Shelby County Department of Human Resources (DHR) just 3 days after she was born. There were no allegations of abuse or neglect. Avyonna was taken because DHR said they had a pick-up order. Social workers believed they had the right to take the new baby since the department already had Haly's other 2 children Haydn and Ka'Myia in custody. During the course of the family's involvement with DHR, it became clear that the department had been planning all along to adopt Avyonna out. It was never about anything that Haly or Anthony did or didn't do. It was a foregone conclusion that the people who were adopting her siblings would adopt Avyonna as well. It was not until media attention from Health Impact News began to shine the light on what was happening with Shelby County DHR that there was any progress toward getting Avyonna home.

Tennessee Kidnaps 3 Boys from Mentally Disabled Mom – Refuses Grandmother Custody in Favor of Adoption to Strangers

A grandmother is fighting to save 2 generations of her family from abuse by the state of Tennessee. Through no fault of her own, her family is being ripped apart, in a terrifying sequence of events that could happen to anyone. She is afraid for 3 of her grandsons who were seized by Tennessee Department of Children's Services (DCS) from their mentally disabled mother. They have suffered horrific abuse in foster care. Now the state is attempting to sever all family ties so that they can adopt them out to strangers. She is also fearful for the life of her 33 year old daughter Tara, the boys' mother, whose mental illness became much worse after the boys were taken. When they learned of the abuse of the boys in foster care, the sense of utter helplessness to protect them pushed her daughter over the edge. The law provides for families to do what families do - for those members who are capable to step in and help other family members who are incapacitated in some way. However, in this family's case, the state seems determined to keep that from happening. The State of Tennessee has cut off all contact between the boys and their family, accusing the grandmother of not being "objective" because she believes that Tara would get better if she had a relationship with her children, and because she does not trust DCS and has repeatedly said that DCS "stole" her grandsons. In addition, the State wants to remove her as her daughter's conservator (guardian) and place her custody under the custody of a mental health doctor instead, thereby opening the door to remove all of her parental rights so they can adopt out her children.

After Public Outcry Oregon Judge Orders Children Returned to Parents with “IQ Too Low to Parent”

In a dramatic turn of events, an Oregon judge has ruled that the children of Amy Fabbrini and Eric Zeigler must be returned home. They were taken by Child Protective Services on the grounds that their parents' IQ was too low to parent. There was no abuse. No neglect. There were only allegations by social workers that they were not clever enough to be parents of their own children. The boys, ages 4 and 10 months, were each seized within days of their births. The state had every intention of terminating their parents' parental rights and adopting them out. Health Impact News was the first to investigate and report their story. Arizona Court Refuses to Return Children Kidnapped from Nevada by Arizona Social Workers Back to Their Parents

The children who were taken out of Nevada by Arizona social workers claim they have been abused in Arizona foster care, and want to go back to their parents. They even filed their own lawsuit, the first ever in Arizona, but an Arizona court has ruled against them. An Arizona appeals court has denied the parental rights of Nevada residents Jeff and Tabitha Shoars. Almost 17 months ago, Child Protective Services from Arizona crossed state lines and seized 6 of their children from Las Vegas, Nevada. All along, they have hoped and prayed for the justice which they felt would surely occur if only judges looked at the actual evidence instead of the hearsay and lies from social workers from Arizona Department of Child Safety (DCS). Instead, like so many other parents who have fought Arizona DCS, they were devastated to hear yet another court deny them their parental rights to the children they brought into the world. Tabitha and Jeff want their children to know that they love them and they are not giving up. If the children are able to access this article, their parents want to send them a message: "We are not giving up on you, no matter what. We are always going to fight for you. We are going to fight as long as there is breath within us. Mommy and Daddy love you so much, more than anything in the world. Arizona Girl Raped and Burned in Foster Care Still Represented by Same Attorney – Kept Away from Family

An Arizona court decided this week that a woman accused of scalding a little girl alive and burning over 80% of her body will go to trial in October 2018. Meanwhile, Samantha Osteraas is out on bail, and the little girl's biological mother is still trying to get justice for her daughter, whose life was destroyed by Child Protective Services and the adults the agency placed her with. While Samantha Osteraas is free to walk the streets as she awaits trial, little Devani's real family has no idea where she is or who the agency has placed her with this time. The court-appointed attorney chosen to represent little Devani and allowed her to remain in foster homes where she was allegedly raped, sexually trafficked, and burned, is the same attorney still representing her today. The foster parents who committed such atrocities are now answering for their criminal acts in the legal system, but the government agencies that placed her there and kept her there until today, are apparently not being held responsible for their parts in these heinous crimes. Where is the justice?

Medical Murder? Massachusetts Woman Medically Kidnapped from Her Home Dies After Being Denied Medical Intervention

The fight to get court-appointed guardians and attorneys to allow 69 year old Beverley Finnegan to receive life-saving medical treatment has ended with her death just before noon on Friday, January 5, 2018. Her tragic death follows the one day that her sister and advocate Janet Pidge were not able to be by her side at Framington Union Hospital due to a brutal snowstorm. Beverley's condition was largely unchanged during the last several weeks, so the Friday morning phone call came as a shock. Family attorney Lisa Belanger calls it "euthanasia" - the hastening of Beverley Finnegan's death. Belanger attempted to file a criminal complaint on Saturday, since euthanasia is illegal in Massachusetts. However, the police denied her request, telling her to file medical malpractice instead.
