Victory! Happy parents after the court hearing:
Statement from family’s attorney:
People inside the court in Sacramento were reporting Monday afternoon that Anna and Alex Nikolayev prevailed against the CPS and “got everything they asked for.” The judge reportedly ruled that the child has to be transported to another hospital for a second opinion no later than tonight. Pending the decision of that hospital (a physician at Kaiser Permanente had already released the child prior to CPS intervening and bringing him back to the original hospital – see story here ), the parents would be free to bring their child home.
A hearing that was scheduled for Monday morning in a Sacramento court room for the case of Child Protection Services (CPS) forcibly removing an infant from Russian parents was delayed past lunch after it was reported that two judges had already declined to preside over the case. See the original story  of how CPS allegedly had police assault the father to gain entrance into the family’s home and take the baby out of the arms of the mother, when all they did was leave one hospital where they were receiving poor care, and seek care in a second hospital, where a physician had already discharged the baby here .
The case has drawn international attention due to the fact that the Russian media is reporting that the couple are dual citizens of both Russia and the U.S.
The Moscow Times reports:
Children’s rights ombudsman Pavel Astakhov has accused U.S. authorities of “severe neglect” for removing 5-month-old Sammy Nikolayev from his Russian parents and advised the parents to take action against them.”This case, of course, has been taken under my control. A lot of information on this case is available, and is still being examined,” Astakhov told RIA-Novosti. “We suggest that the parents make a complaint so that their child is returned. This process will not be quick, but I think we will succeed.” Full story here .

Social media was buzzing Monday as concerned people followed the story. Reports that Facebook had shut down some pages that were supporting the family have circulated, but it was not yet clear whether this was intentional or not.
Apparently, CPS in Sacramento has come under scrutiny lately as one of their child abuse investigators became the target of a state foster care probe. The CPS investigator was allegedly under investigation for child abuse, for allegedly “locking children in her garage for hours without food or water,” before being hired by CPS as an investigator. Many of the Facebook Pages recently started to support the Nikolayev family have been documenting similar abuses by CPS, and now it is being reported that those pages have strangely disappeared.
